Boss Up Solutions – Terms & Conditions
1. Estimates
All estimates are based solely on the information provided by the client. The client is responsible for ensuring all submitted information is accurate and complete. Any inaccuracies or omissions may result in additional charges for revisions, corrections, or rework.
2. Revisions
Estimates include revisions at no additional charge for up to 30 days from the date of submission.
Revisions requested after this period may be subject to additional fees.
3. Claims Bundles
For claims bundle services, Boss Up Solutions will provide revisions and supplements at no additional charge while the claim is actively being processed with the insurance carrier, in accordance with carrier guidelines and requirements.
4. Fees & Invoicing
Fees are billed upfront unless otherwise stated.
Any additional services, overages, or scope changes will be billed upon completion.
Pricing is subject to change at any time.
Current Fee Structure Includes (but is not limited to):
Supplement360: $425 per file
Estimates: Based on current online pricing at time of submission
5. Payment Authorization
By submitting a task or engaging services, the client authorizes Boss Up Solutions to charge the payment method on file in accordance with the applicable fee schedule.
6. Subscription Services, Billing & Cancellation Policy
Boss Up Solutions allocates staff and operational resources to each client. The following terms apply:
a) No Long-Term Contract
Services are provided without a fixed-term contract; however, billing obligations apply as outlined below.
b) Minimum Commitment
All new service engagements require a minimum initial commitment of one (1) full billing cycle. No cancellations are permitted during this initial period.
c) Full Billing Cycle Requirement (No Partial Months)
Billing is based on full monthly cycles only.
Once a new billing cycle begins (e.g., the 1st of the month), the client is financially responsible for the entire billing period through the next billing date.
No prorated refunds, credits, or partial-month cancellations will be provided.
d) Cancellation Notice Requirement
Clients must provide a minimum of ten (10) days written notice prior to the next billing date to cancel services.
If proper notice is not received, the next billing cycle will be charged in full.
e) Service Continuation
Services will remain active through the end of the paid billing cycle, even after cancellation notice is submitted.
7. Refunds & Chargebacks
All payments are non-refundable unless otherwise agreed in writing.
Clients agree to contact Boss Up Solutions to resolve any issues prior to initiating a chargeback.
Unauthorized chargebacks may result in immediate suspension of services and may be subject to collections and additional fees.
8. Late Payments
Any unpaid balance may result in suspension of services.
Past due invoices may incur a late fee of up to 5% per month or the maximum allowed by law, whichever is lower.
Client agrees to cover any reasonable collection costs, including legal fees if applicable.
9. Service Pause Policy
Service pauses are not guaranteed and must be approved in writing.
Approved pauses do not retroactively adjust billing and may be subject to a reduced “retainer” fee to maintain staffing availability.
Reactivation of services is subject to availability and may require a restart fee.
10. Dispute Resolution
Boss Up Solutions will make reasonable efforts to resolve disputes in good faith. Clients agree to contact the company directly to resolve issues prior to pursuing external action.
11. Non-Solicitation & Staff Protection
a) Non-Solicitation
The client agrees not to directly or indirectly solicit, hire, or engage any Boss Up Solutions staff member outside of the company.
b) Violation Penalty
Violation of this clause may result in a fee of up to $10,000 per occurrence, agreed as a reasonable estimate of damages.
c) Buyout Option
Clients may submit a written request to hire a staff member. Approval is at the sole discretion of Boss Up Solutions and may include a buyout agreement.
d) Reporting Obligation
If a staff member initiates outside contact, the client must notify Boss Up Solutions immediately.
e) Time Restriction
Clients may not hire or engage staff for 12 months following the staff member’s separation from Boss Up Solutions.
f) Mutual Non-Solicitation
Boss Up Solutions agrees not to solicit or hire the client’s employees under the same terms.
12. Limitation of Liability
Boss Up Solutions is not liable for outcomes dependent on third parties, including but not limited to insurance carriers, municipalities, or contractors. Services provided are administrative, advisory, and support-based.
13. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.
Any disputes arising under or related to these terms shall be resolved in the appropriate courts located within Wyoming.
14. Modifications
Boss Up Solutions reserves the right to update or modify these Terms & Conditions at any time. Continued use of services constitutes acceptance of any updated terms.
15. Acceptance of Terms
By submitting a task or using Boss Up Solutions services, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
